Migration law


Immigration law is the area of law that concerns the right of foreign nationals and stateless persons to reside permanently in Sweden. There is often a great deal of uncertainty among individuals regarding what immigration law actually entails and how the process works. Migration law can, for example, involve seeking asylum because one needs protection from something in one’s home country or applying to stay in Sweden to work.

Immigration law is an umbrella term for the area of law that deals with the rights of foreign nationals to reside in Sweden. The primary law within immigration law is the Aliens Act (UtlL). It is the national state that grants and defines the rights and obligations of foreign nationals within the state’s territory. There is therefore no international or global migration law. In Sweden, the Swedish Migration Agency handles migration cases. If the applicant is dissatisfied with the Swedish Migration Agency’s decision, they may appeal to the Migration Court. If the applicant is dissatisfied with the Migration Court’s decision, there is also the option to appeal to a further instance, namely the Migration Court of Appeal. To bring a case before the Migration Court of Appeal, leave to appeal is required.
